BREAKING: APC’s Omo-Agege loses as Appeal Court dismisses his suit against Delta governor Oborevwori

The Court of Appeal, sitting in Lagos Division, has dismissed the appeal filed by the Delta State governorship candidate of the All Progressives Congress (APC), Ovie Omo-Agege against Sheriff Oborevwori, governor of Delta State.

Recall that Omo-Agege had filed the appeal to challenge the judgment of the state governorship election petition tribunal, which upheld the election of Governor Oborevwori in the March 18th, 2023 governorship election.

Omo-Agege had asked the appellate court to declare him the winner of the gubernatorial election because he garnered the majority of the lawful votes cast.

He accused the Independent National Electoral Commission (INEC) of declaring Oborevwori winner with excess votes that resulted from over-voting.

Meanwhile, delivering its judgment Friday in Lagos, on the appeal filed by the Delta State governorship candidate of the All Progressives Congress, (APC) and immediate past Deputy Senate President, Ovie Omo-Agege, the Court of Appeal dismissed the appeal for lack of merit.

In a related development, an Appeal Court sitting in Lagos has upheld the election of Francis Nwifuru of the All Progressives Congress (APC) as the duly elected governor of Ebonyi State in the March 18 gubernatorial poll.

The three-member panel, presided over by Justice Jummai Sankey, dismissed the appeal filed by Chukwuma Odii of the Peoples Democratic Party (PDP), challenging the validity of Nwifuru’s election.

In a unanimous decision, the court resolved all five issues raised by the PDP in favour of Nwifuru, ruling that the appeal lacked merit and should be dismissed.

Justice Sankey, in her lead judgment, said that the PDP and its candidate had no legal standing to interfere in the internal affairs of the APC, particularly regarding the nomination of candidates.
